Affiliate Agreement

This Affiliate Agreement ("Agreement") is a binding legal agreement governing participation in Dovito®'s affiliate marketing program between you ("Affiliate," "You") and Dovito® Business Solutions, Ltd. ("Dovito," "we," "us").

1. Program Application

By applying to the Dovito Affiliate Program, you agree to provide truthful and accurate information. Dovito retains sole and exclusive discretion to determine whether you qualify for participation in the program. Acceptance is not guaranteed, and Dovito may reject any application without providing a reason.

2. Program Rules

As an Affiliate, you agree to comply with all applicable laws and regulations, including FTC guidelines for endorsements and advertising disclosures.

2.1 Required Disclosures

You must plainly display the following disclaimer in connection with any promotion of Dovito services:

"I am an independent entity from DOVITO. I am not an agent or employee of DOVITO. This promotion is based on my own experience with DOVITO's services. Individual results may vary."

2.2 Social Media Requirements

• Instagram: Use the "Paid Partnership" tool for all promotional posts
• YouTube: Display "Ad" or "Advertisement" visibly throughout the video
• All Platforms: Clearly identify sponsored content as such

2.3 Marketing Claims

You may NOT:

• Claim or guarantee specific earnings or results
• Represent that Dovito is a "business opportunity" or income-generating scheme
• Make false, misleading, or unsubstantiated claims about Dovito services
• Create the impression that you are an employee or official representative of Dovito

2.4 Prohibited Activities

• Cookie stuffing or other fraudulent tracking methods
• Unsolicited spam emails or messages
• Deceptive links or hidden redirects
• Misleading advertising or false claims
• Bidding on Dovito branded keywords in paid advertising
• Using Dovito trademarks in domain names

3. Compensation

3.1 Commission Rate

Affiliates earn a commission of 15% on qualifying sales for single location accounts.

3.2 Qualifying Sales

A commission is earned only when:

• The referred prospect becomes a paying customer
• The customer's account remains in good standing for at least forty-five (45) days
• The sale was properly tracked through your affiliate link

3.3 Payment Terms

• Minimum payout threshold: $50
• Unpaid commissions below the threshold are forfeited after 120 days of inactivity
• Payments are made monthly for qualifying commissions
• Fraudulent sales result in forfeiture of all commissions and potential termination

4. Intellectual Property

Dovito grants you a limited, non-exclusive license to use Dovito marketing materials solely for promoting Dovito services as part of this program. You may NOT:

• Modify, alter, or create derivative works from Dovito materials
• Use Dovito trademarks in a way that suggests endorsement or partnership beyond this agreement
• Register any domain names containing Dovito trademarks

All goodwill from the use of Dovito trademarks benefits Dovito exclusively.

5. Termination

5.1 Voluntary Termination

Either party may terminate this Agreement with 30 days written notice.

5.2 Termination for Cause

Dovito may terminate immediately for:

• Breach of this Agreement
• Fraudulent activity
• Conduct that damages Dovito's reputation
• Violation of applicable laws

5.3 Effect of Termination

Upon termination:

• All rights granted under this Agreement immediately terminate
• You must cease all use of Dovito marketing materials
• Unpaid commissions may be forfeited if termination is for cause

6. Representations and Warranties

You represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into this Agreement
• You will comply with all applicable laws and regulations
• All information provided in your application is accurate

7. Limitation of Liability

Dovito's liability under this Agreement is limited to unpaid commissions earned prior to termination. Dovito is not liable for indirect, incidental, special, consequential, or punitive damages.

8. Indemnification

You agree to indemnify and hold Dovito harmless from claims, damages, and expenses arising from your breach of this Agreement, your promotional activities, or your violation of applicable laws.

9. Independent Contractor

You are an independent contractor, not an employee, partner, or agent of Dovito. This Agreement does not create any employment, partnership, or joint venture relationship.

10. Modifications

Dovito may modify this Agreement at any time. Changes will be communicated via email or posted on our website. Continued participation after modifications constitutes acceptance.

11. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through:

• Mandatory binding arbitration in Weld County, Colorado
• Class action waiver: You agree to resolve disputes individually, not as part of a class action

12. Governing Law

This Agreement is governed by the laws of the State of Colorado without regard to conflict of law principles.
